To Members of the California State Senate:
I am returning Senate Bill 2146 without my signature.
This bill would allow batteries containing zinc, copper and
electrolytes that exceed the Department of Toxic Substances Control
hazardous waste thresholds to be disposed of a municipal solid waste
landfills.
I understand the author's concern that alkaline batteries often end
up in California's landfills, in spite of their identification and
regulation as a hazardous waste. However, the hazardous exemption
provided by SB 2146 goes too far and is not protective of public
health or the environment. According to the Department, alkaline
batteries have a high pH level that has the potential to mobilize
other dangerous hazardous constituents (arsenic, hexavalent chromium,
etc.) and pollute water supplie s. The existence of alkaline dry
cell battery recycling facilities demonstrates that recycling is an
available option.
